1. I understand this is an Agreement for purchasing my services as an independent contractor and no relationship of employer and employee, partner or other relationship is created or intended to be created by this Agreement for any purpose.

1. I understand no one has the right to, nor can, control, direct, approve or change the details, manner or means by which I perform my services as long as I comply with guidelines, policies and procedures as outlined herein.

2. I understand my services will no longer be purchased if I do not comply with guidelines / rules / regulations / policies and/or procedures as outlined in this Agreement on this website.

1. I understand there may be frequent changes to this Agreement and I am responsible for reviewing this Agreement on this website on a regular basis and complying with any and all changes and updates.
   
2. I agree to stop working and provide immediate written notification of same if I decide not to comply with any of the changed guidelines / rules / regulations / policies and/or procedures as outlined in this Agreement on this website.
   
3. I also understand that as an independent contractor I have the right to permanently stop providing my services at any time I choose, and this Agreement in no way requires me to continue providing services when I no longer choose.

3. I understand for my safety, security, and protection it is in my best interest never to provide a caller with any of my personally identifiable information, such as my full legal name, information leading to my specific location, my direct phone number, etc.

1. I agree to provide the Network with the name I will use on the phone which will not be anyone else's real name.
   
2. I understand I must inform the Network of any change in the name I use on the phone so I can be properly identified if a caller cannot remember my extension and wishes to ask for me by name.

4. I understand the telephone I use for this work cannot have voice mail, call waiting or custom ring features. I agree to contact my phone company and remove these features if I have them prior to starting work. (phone tip)

1. I understand having an answering machine connected to my work phone at times I am working may result in my extension being invalidated and my services no longer being purchased.
   
2. I also understand if I use a cell or mobile phone I am responsible for ensuring I have a back-up battery fully charged and available at all times I am working; and that if I am disconnected from a caller due to a battery failure my extension may be invalidated and my services may no longer be purchased.

5. I understand my services are being purchased for a psychic service providing readings over the telephone and perhaps in time over the internet as well.

1. I understand the reputation and success of the business depends on the quality and integrity of its Readers.
   
2. I agree to fill out an Experience Form and will provide honest and accurate information on this Form to the best of my knowledge and ability.

6. As an independent contractor I understand I will receive commissions as detailed below in Part II Commission Schedule Agreement

1. I understand I am not entitled to any benefit plan other than those outlined herein, including, but not limited to, health insurance, life insurance, disability insurance, unemployment insurance, pension or profit sharing, worker's compensation, paid vacation or sick pay.

7. I understand the Network and its affiliates, in order to ensure I am providing appropriate quality of service to my callers, reserve the right to monitor my phone calls at any time they choose without notifying me.

8. I understand from time to time there may be the possibility of my receiving a "full line alert" email or phone call asking me to log on and take calls immediately. I understand I am under no obligation during those times to take calls, but agree to make every effort to log on at those times.

9.. I understand I am encouraged to make future appointments with callers when they are initially on the phone and I may designate any date and time for these appointments which the caller and I choose.

10. I understand in order to ensure the growth of my independent contracting business it is in my best interest to market my services and through the Network I will be provided with promotional ideas along with promotional materials/items, which I may copy and distribute completely free of charge.

1. I submit the proposed material to the Network.no less than 10 days in advance of payment and/or placement of such material.
   
2. I acknowledge the Network reserves the right to reject any advertising if there is cause to believe such advertising is illegal, unprofessional and/or will damage the reputation of the company and/or its affiliates.
   
3. The material is not placed with any competing service material, such as, but not limited to, another website which may have products and/or services not connected to the Network.
   
4. Unless I request and receive advance written authorization waiving these requirements, I also understand failure to comply with this paragraph #10 may result in my extension being invalidated and my services no longer being utilized.
   
5. I understand the Network cannot reject my own promotional material for any other reason except as stated herein and I am responsible for all content contained in the material I distribute.

12. I fully understand that as an independent contractor my taxes are my own responsibility. I release the Network. and all of its ancillary company/network affiliates from the liability and/or obligations of paying and/or withholding any Federal, State, City, Local, FICA, Payroll or other similar taxes which I may owe. I also fully understand that all amounts paid to me will be reported to the IRS at the end of each calendar year for which I shall receive a 1099 form if I have earned in excess of $600.

13. I agree my telephone bills are my own and I am responsible for paying them and for keeping my phone service active if I want to provide services as described in paragraph #5 above.

14. I understand any cost of advertising I decide to do on my own in addition to the free services provided through the Network,, such as designing and photocopying flyers, placing print ads and/or buying media advertising are solely my own responsibility.

15. I hereby authorize the Network and its affiliates to send emails directly to me containing information I may need or may be of benefit to me in performing my services.

16. I understand I may share my extension with anyone I choose as long as:

1. the person completes and submits an Experience Form, along with the phone name to be used, prior to taking a call.
   
2. the person is not a minor
   
3. the person complies with all guidelines, policies and procedures as outlined herein
   
4. it is understood the extension belongs to strictly one telephone number

17. I agree I will NEVER violate any Federal law, State law, or local ordinance applicable to this industry and furthermore I will NEVER use the Network. and/or its affiliates to solicit or commit fraud or any illegal act in any manner. This includes, but is not limited to: soliciting callers over the phone; using personally identifiable information obtained from callers for my own sole profit; dispensing medical or legal advice in a manner which attaches legal liability; using a script; placing a caller on hold; using rude, abusive or foul language in a manner which offends a caller, conducting an unauthorized conversation with a minor; claiming a call is anything more than entertainment; assuring lottery numbers given are winning numbers; and/or any other attempt to use the 877 toll free number, or other company resources, for the purposes to defraud or commit an illicit/illegal act.

1. I understand violators of this policy are subject to having their Extension/Pin numbers immediately invalidated and are also potentially subject to civil prosecution to the full extent permissible by law.
   
2. Additionally, I understand that should such a violation take place, the Network. will provide assistance for full criminal prosecution whenever asked or required to do so by law. To this purpose violators may be reported and their violations documented to the FCC/FTC or any other appropriate national or local legal authority where such acts fall within such authority's jurisdiction.
   
3. I also understand my services may no longer be purchase and my extension invalidated if I allow an unauthorized individual to give readings on my phone.

18. I agree, should I have any type of dispute regarding this position or my commissions, to put the full and complete details of the dispute in an email and send it to PsychicSolution@yahoo.com and allow ten (10) days for a response before taking any other action.

1. I understand my services are being purchased for "paid talk-time" minutes, (calculation tip) which are the minutes the caller is paying to be connected to me on the phone.

2. I understand each work week begins the first second (12:00:01 am) of every Monday and ends exactly at midnight on Sunday (East Coast Time). Further, I understand my total minutes are then calculated for the week and my wages will be mailed to me on approximately each FOLLOWING Saturday.

4. I further understand my commission rate can increase based on my performance, which means the more callers who ask for my extension and the longer my call length average is, the higher my weekly commission check will be.

C. Reduction Of Pay

I understand that any payment of less than $5.00 will be withheld for paperwork processing feesC.
